When handling matrimonial dispute, the Court always put children’s best interest on the paramount importance. While there were no two cases being identical, when granting the custody, care and control, the Court in general needs to consider a basket of factors, including,
- Status Quo, with least disturbance to children
- Age of the parents and children (young children are usually granted care and control to the mother)
- Ability and character of the parents
- Financial resource (being less considered now as that can be handled by ancillary relief)
- Mental health of parents
- Special need of the children
- View of children (for those older children)
